1.1 The Promotor of all prize draws hosted on Prizefunder.co.uk – is ‘Prizefunder’ trading name of “Fundraising Solutions Ireland Ltd”, companies House Number NI676028 with a registered address at 15B Broad Street, Magherafelt. Northern Ireland. BT45 6EB. Also referred to as ‘promotor’ ‘we’ or ‘prizefunder’.

1.2 The Prize draws are open to all persons aged 18 and over and the age of majority in their country of residence excluding the Promoter's employees or members of their immediate family and any commercial partners.

1.3 The Promoter reserves the right to refuse a Customer’s Entry at the Promoter’s own discretion.

2.0 Laws and Regulations

2.1 Please take time to read these Terms and Conditions carefully as this is a binding contract.

2.2 Prizefunder operates prize draws that are available via a paid or free entry route (refer to clause 7.10 for free entry route).

2.3 By entering a Prize draw the entrant (‘Entrant’, ‘you’, ‘your(s)’ and/or ‘Customer’) will be deemed to have legal capacity to do so, you will have read and understood and accepted these terms and conditions and you will be bound by them and by any other requirements set out in any of the Promoter’s related promotional material.

2.4 Prize draws are governed by Northern Irish Law and all and/or any matters or disputes relating to the prize draws will be dealt with and/or resolved under Northern Irish Law and the Courts of Northern Ireland shall have exclusive jurisdiction.

2.5 In the event that you participate in any of our Prize draws, and by accepting these terms and conditions, you hereby confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Prize draws. The Promoter will not be held responsible for any Entrant entering any of our Prize draws unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3.0 Non Profit Organisations (referred to as NPO’s)

3.1 All our prize draws are promoted for the purposes of raising funds for NPO’s. NPO’s can include but are not limited to charities, charitable associations, community amateur sports club and educational institutions.

3.2 When donating to enter any prize draws, I agree to the following breakdown of costs:

Community Draws:

-60% will go to my chosen NPO

-25% will go towards the winner

-5% will go towards the winners chosen NPO

-Prizefunder will retain a fee of 10% (inclusive of VAT) commission on ticket sales, meaning for every £1 spent only 10p is retained by Prizefunder. This is for managing all aspects of the promotion including transaction fees

For any other Draws,Prizefunder will retain 12%(inclusive of VAT)as the commission rate.

3.3 A fundraising agreement will be completed with all NPO’s in advance of funds being raised on their behalf on our site.

3.4 Community Draws can also include 3rdparty fundraising through corporate organisations on behalf of NPO’s, in which case funds are transferred directly to the named cause and where prior approval from the NPO has been obtained as per the Fundraising Agreement.

3.5 Each corporate organisation will have their own page and portal to track progress made on their behalf. By entering via a corporate page, I agree to my full name, donation amount and details of ticket entries being made available to them.

 

4.0 Sponsors

4.1 Prizefunder is the official promotor of each prize draw; however on occasion some individual prize draws have a ‘Sponsor’.

4.2 Sponsors can be businesses or individuals who are looking to raise money for NPO’s and have provided a prize.

4.3 Sponsors may on occasion be responsible for providing and arranging collection/delivery of the associated prizes for the relevant prize draws. If so details will be provided when specific terms for that prize draw are released.

4.4 Where the Sponsor is a businesses or an individual, prior approval from the NPO is required.

4.5 Prizefunder will be responsible for holding any funds raised and providing the proceeds directly to the NPO in accordance with their fundraising agreement.

4.6 Where there is no Sponsor, Prizefunder is responsible for providing the associated prizes for the relevant prize draws unless stated otherwise on the website.

5.0 The Prize Draw

5.1 These terms and conditions apply to all prize draws (also referred to as ‘Promotion’ ‘Campaign’ or ‘Fundraiser’) listed on the Promoter’s website at www.prizefunder.co.uk (the “Website”).

5.2 An entry fee is payable each time you enter online as detailed in the ticket prices.

5.3 The odds of winning each prize draw depends on the total amount of entries.

6.0 Campaign Prizes

6.1 The Promotor may operate multiple prize draws at any one time and each prize draw will have a specific Prize or Series of Prizes as described on the website.

6.2 Details of the Campaign Prize or series of prizes are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date. If any details of the Prize change, the Promoter will endeavour to update the Website as soon as reasonably possible.

6.3 Campaign Prizes are subject to availability. The Promoter reserves the right to substitute the prize if deemed necessary to that off an equal comparison.

6.4 All prizes are provided as detailed. Any warranty is as provided by the supplier. Prizefunder are not responsible or liable in anyway for Prizes provided by suppliers.

6.5 The Campaign Prize may be supplied by a third-party supplier (the “Supplier”) and are owned by them, from the date of the Campaign going live on the Website to the date that the winning Participant receives the Prize.

 

6.6 The Campaign Prize may also be supplied by the NPO’s or Sponsors who are obliged to ensure that the Details of the Campaign Prize or series of prizes are, to the best of the their knowledge, information and belief, correct as at the Opening Date.

6.7 There is not always a cash alternative for the prize unless stated in the details of the specific prize draw beforehand.

6.8 It is important to read any specific terms and conditions for each individual ‘prize draw’ or ‘promotion’ as they may amend these terms and conditions and it is the amended terms and conditions which shall apply.

7. Prize Draw Entry

7.1 The prize draw will run from and including the opening and closing dates specified on the Website. These dates shall be referred to as the "Opening Date" and "Closing Date" respectively. All times and dates referred to are the times and dates in Greenwich Mean Time.

7.2 If it is absolutely necessary to do so, the Promoter reserves the right to change the Opening and Closing Dates. If the Promoter does change the Opening Date and/or the Closing Date of a prize draw, the new details will be displayed on the Website.

7.3 All prize draw entries must be received by the Promoter by no later than the specified time on the Closing Date. All prize draw entries received after the specified time on the Closing Date are automatically disqualified and no refunds will be given.

7.4 If there is a maximum number of entries to the prize draw this will be stated on the Website for each individual prize draw. The number of entries you are able to make may be limited if the maximum number of entries is reached.

7.5 How to Enter

At Prizefunder, we believe that raising awareness and indeed funds should be innovative and reflect the times. Our model allows us to really make a difference and offers a modern fundraising route. Each promotion allows you to support the chosen NPO by making a monetary payment to us (Entry fee).

When playing a Prize draw online via the Website, you must follow the on- screen instructions to:


(a) go to the Website and choose the Prize Draw you wish to enter;

(b) choose how many entries you want;

(c) Make payment; then

(d) Provide some contact details.



7.6 The Promoter will send confirmation that your entry has been received.

 

7.7 All online entries are non-refundable


7.8 The Promoter will not accept responsibility for prize draw entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.


7.9 By purchasing entries and entering a prize draw, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions.

7.10 You may enter the prize draw for free by complying with the following conditions:

Register your account online and send your entry by first class post to the Promoter at the following address: 15B Broad Street, Magherafelt. Northern Ireland. BT45 6EB detailing the following information:


(a) The prize draw you would like to enter

(b) Your full name and postal address

(c) Telephone number and email address

(d) Your date of birth

(e) Confirmation that you agree to the terms and conditions

Please read the following information regarding free entries:

•You may make multiple free entries for any draw (up to any limit placed on entries by the Promoter) but each free entry must be submitted and posted to the Promoter separately. Bulk entries in one envelope will not be accepted as multiple entries and if a bulk entry is received, it will be counted as one single entry.

•Free entries are treated in the same way as paid entries and have an equal chance of winning a prize.

•Free entries must be received by the Promoter in advance of the Closing Date. Any free entries received after this date will not be entered into the draw.

All entries must be submitted in the English language. Entries in languages other than English will automatically be disqualified and no refund will be given. If free entries are received after the maximum number of entries for the prize draw has been reached, they will not be processed and correct entries will not be entered into the draw.

•It is the Entrant’s sole responsibility to ensure that their entry is received by the Promoter in advance of the deadline.

•The Promoter is under no obligation to confirm whether or not an entry was received prior to the deadline.

Proof of posting will not be accepted as proof of delivery

8. Eligibility

8.1 Prize draws are open to all persons aged 18 years or over and who are eligible as per the laws of their country of residence, with the exception of:

(a) employees of the Promoter;

(b) employees of commercial partners of the Promoter, who are professionally connected with the prize draw or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

8.2 As a condition of entering the Prize draw, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Prize draw unlawfully,

8.3 By entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. Prizefunder reserves the right to request evidence such as documentation detailing you are over 18 years old.

8.4 By entering the prize draw you are confirming that you have read the specific terms for each individual prize draw and that you are in agreement with the specific terms regarding the delivery and collection of prizes for that prize draw.

8.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

8.6 No refunds of the entry fee will be given in any event, including;

(a) if, following your entry into the prize draw, you subsequently find out that you are not eligible to enter the prize draw or claim the Prize as detailed;

(b) if, following your entry into the prize draw the eligibility criteria for entering the prize draw or claiming the Prize changes and you are no longer eligible; or

(c) if you are disqualified from the prize draw by the Promoter for any reason.


9.0 The Winner


9.1 All entries are entered into an automated draw where we use our computer generator to select winners at random. An inbuilt timestamp will be utilised to evidence the time the draw has taken place and that it has only been drawn once. On occasion and if agreed in advance with the NPO the winner will be chosen from the entry list using Google’s random number generator and streamed live, should this be the case it will be detailed in the terms of that particular promotion. The random draw will take place on the date detailed on the prize draw or as soon as reasonably possible and, in any event, within 3 days of the Closing Date if the prize draw closes early.

9.2 If collection of the Prize is required then Proof of identity must be provided upon collection that must match that of the details provided when entering the respective prize draw.

9.3 The decision of the Promoter is final and no correspondence or discussion will be entered into.

9.4 The Promoter will contact the winner personally as soon as practicable after the Draw Date, using the telephone number or email address provided with the prize draw entry. If the winner cannot be contacted or is not available or has not claimed the Prize within 14 of days of the Draw Date, the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the entries that were received before the Closing Date.

9.5 If you are the winner of any promotion we will share very basic details about you; this includes your surname and first name initial for example Mr P. Smith. We will also share the name of the non-profit for which you have selected as your beneficiary. If you do not want this information shared publicly please contact us by email team@prizefunder.co.uk in advance of the winner being drawn.

You may be invited to participate in publicity exercises relating to the competition. Your participation is not compulsory but would be greatly appreciated by us. If you do not wish to participate your participation in the competition or chances of winning will not be affected in any way.

However, if you do not wish to participate in any publicity and decline to be named as the winner, we may still have to provide your details to the Advertising Standards Authority (ASA) as proof that the competition has been properly administered and the prize awarded. This is a legal requirement we must comply with. If you require detail of how the ASA will use and process your personal data, please let us know.

10. Claiming the prize

10.1 You must claim the Prize personally if collection is required. The Prize may not be claimed by a third party on your behalf. Details of how the Prize can be collected or delivered to you are published on the Website for each individual prize draw.

10.2 If your personal details, including contact information, changes at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to 
team@prizefunder.co.uk . Notifications must include details of the prize draw you have entered, your old details and your new details. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.

10.3 Any Cash Prize will be transferred directly to the winners nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the prize draw and the winner forfeiting the prize. In such circumstances, the Promoter reserves the right to offer the prize to the next eligible Entrant selected from the entries that were received before the Closing Date.

10.4 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

11.0 Claiming Prizes provided by the NPO’s or Sponsors

Prizefunder will inform the NPO’s or Sponsors of the winning entrant and provide their contact details, both parties will then finalise delivery/collection arrangements in line with that specified in the terms of the promotion.

12. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

13. Force Majeure

The Promoter, its agents or distributors shall not have any liability under or be deemed to be in breach of these terms and conditions for any delays or failures in performance of the terms and conditions which result from circumstances beyond the reasonable control of that party. An Entrant affected by such circumstances shall promptly notify the Promoter in writing when such circumstances cause a delay or failure in performance.

14. Data protection and publicity

14.1 By entering the prize draw, you agree that any personal information provided by you with the prize draw entry may be held and used only by the Promoter, your chosen NPO or its agents and suppliers to administer the prize draw or as otherwise set out in the Promoter’s Privacy Policy, a copy of which is available on the Website.

14.2 By entering the prize draw, you also agree that Prizefunder will share your name, email address and usage with the non-profit in which you have donated to.

14.3 If you are the winner of the prize draw, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the prize draw and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the entries that were received before the Closing Date.

14.4 Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the prize draw as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the prize draw. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at 
team@prizefunder.co.uk prior to the Closing Data.

15. General

15.1 The Promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the Website.

15.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw and any future prize draws.

15.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize prize draw where it becomes necessary to do so.

15.4 The prize draws on the Website are in no way sponsored, endorsed, administered by or associated with Facebook. By entering the prize draws, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the prize draws.

15.5 These terms and conditions shall be governed by Northern Ireland law, and the parties submit to the exclusive jurisdiction of the courts of Northern Ireland.

15.6 You should print a copy of these terms and conditions and keep them for your records.
